• Description of Service SUPERBITALY.COM is a web platform that selects and displays tourist services offered by third parties. Users can opt for these services through the Platform. SUPERBITALY.COM does not retain any commission and solely promotes the tourist services for free.

• Use of the Platform a. Eligibility: You must be at least 18 years old to use our Platform. By using the Platform, you declare and warrant that you are of legal age to enter into a binding contract. b. User Account: To access certain features of the Platform, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and agree to notify us immediately of any unauthorized use of your account. We are not responsible for any losses arising from unauthorized use of your account.

• Tourist Services and Limitation of Liability a. Promotion of Services: The Platform solely promotes tourist services offered by third parties and is not responsible for the quality, accuracy, timeliness, reliability, or completeness of such services. All bookings and agreements are directly between the user and the service provider. b. Disclaimer of Warranties: The Platform is provided “as is” and “as available” without any warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, or completely secure. c. Limited Liability: SUPERBITALY.COM will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Platform, including but not limited to loss of profit, business interruption, loss of programs, or other data, even if SUPERBITALY.COM has been expressly advised of the possibility of such damages. d. Disclaimer for Claims and Accidents: SUPERBITALY.COM disclaims any liability for any claim, accident, damage, injury, or loss of any kind that may result from the use of the services promoted on the Platform. Users and providers agree that SUPERBITALY.COM is not responsible for any dispute, claim, loss, or damage arising from the services offered by the providers themselves. By using the Platform, users and providers agree to release SUPERBITALY.COM from any liability in this regard.

• User Conduct You agree not to use the Platform to:

  • Violate any applicable local, state, national, or international law.
  • Upload, post, transmit, or otherwise make available any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Upload, post, transmit, or otherwise make available any material that contains viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware

• Provider Responsibilities a. Release of Liability: By uploading their services to the Platform, providers release SUPERBITALY.COM from all liability (both towards customers and providers) in case of claims of any nature. Providers agree that SUPERBITALY.COM is not responsible for any disputes, claims, losses, or damages arising from the services offered by the providers themselves. b. Self-Certifications and Declarations: Providers self-certify and declare that they have regular insurance coverage for customers and possess all necessary legal and fiscal qualifications in the country where they operate. Providers are responsible for ensuring that their services comply with all applicable local, state, national, and international regulations. SUPERBITALY.COM reserves the right to request and verify such certifications and documents. c. Nature of the Platform: By registering on the Platform, providers acknowledge and accept that the Platform is merely a venue where demand and supply meet. Providers are directly responsible for any liability towards customers for the services offered.

• Intellectual Property All content available on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of SUPERBITALY.COM or its content providers and is protected by international copyright laws. You may not reproduce, distribute, modify, create derivative works, publicly display or perform, republish, download, store, or transmit any material on the Platform without our prior written consent.

• Links to Third-Party Sites The Platform may contain links to third-party websites. These links are provided solely for your convenience. We do not control, endorse, or are responsible for the content, privacy policies, or practices of such third-party sites. • Indemnification

COM, its affiliates, licensors and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, User Submissions, any use of the Platform content, services and products other than as expressly authorized in these Terms.
